Terms of Service

These Terms of Service ("Terms") govern your access to and use of the BrandsAPI platform, including our API, website, and related services.

1. Acceptance of Terms

By accessing or using BrandsAPI, you agree to be bound by these Terms. If you do not agree, you may not use the service. If you are using BrandsAPI on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. API Access and Usage

Your use of the BrandsAPI is subject to the following:

  • API Keys: You are responsible for maintaining the confidentiality of your API keys. Do not share or expose API keys in client-side code, public repositories, or insecure environments.
  • Rate Limits: Each plan has defined rate limits. Exceeding these limits may result in throttled or suspended access.
  • Acceptable Use: You may not use BrandsAPI to scrape, mirror, or redistribute brand data as a standalone dataset. Our API is intended for integration into your applications.
  • Caching: You may cache API responses for up to 30 days on paid plans. Free plan users are subject to fair use caching policies.

3. Account Registration

To access the API, you must create an account and provide accurate, complete information. You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

4. Billing and Payments

  • Free Plan: The Free plan provides limited API access at no cost, subject to fair use limits.
  • Pro Plan: $50/month, billed monthly. You may cancel at any time; access continues until the end of the billing period.
  • Refunds: We do not offer refunds for partial billing periods. If you cancel, you will not be charged for subsequent periods.
  • Price Changes: We will provide at least 30 days' notice before changing prices for existing subscribers.

5. Intellectual Property

BrandsAPI and its underlying technology, documentation, and design are the intellectual property of BrandsAPI Inc. Brand data returned by the API (logos, colors, fonts) belongs to the respective brand owners. Your use of such data must comply with the applicable brand's usage guidelines.

6. Data Accuracy

We strive for the highest data accuracy in the industry. However, brand data is provided "as is" without warranty of absolute completeness or accuracy. Brands may update their assets at any time, and there may be a brief delay before our index reflects those changes.

7. Limitation of Liability

To the maximum extent permitted by law, BrandsAPI Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.

8. Service Availability

We target 99.9% uptime for paid plans. However, we do not guarantee uninterrupted service. Scheduled maintenance windows will be communicated in advance. We are not liable for downtime caused by factors outside our reasonable control.

9. Termination

We may suspend or terminate your access if you violate these Terms, abuse the API, or engage in activity that harms other users. Upon termination, your right to use the API ceases immediately. You may terminate your account at any time from your dashboard.

10. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email to registered users at least 30 days before taking effect. Continued use after changes constitutes acceptance.
